Terms & Conditions

1. Definitions

"Deepkeel", "we", "us" or "our" refers to Deepkeel, operating from 9 Jalan Teluk Kumbar, 11920 Bayan Lepas, Penang, Malaysia. "Guest" or "you" refers to any person who enquires about, books, or participates in a Deepkeel voyage. "Service" refers to the yacht tour journeys we offer. "Voyage" refers to any single Deepkeel journey — half day, island day, or overnight passage. "Agreement" means these Terms and Conditions together with any booking confirmation.

2. Acceptance

By submitting an enquiry form on our website or confirming a booking, you confirm that you have read and agree to these Terms and Conditions. You must be 18 years of age or older to book a voyage. Guests under 18 may participate only when accompanied by a parent or legal guardian who has accepted these terms.

3. Service Description

Deepkeel offers three distinct yacht voyages departing from Teluk Kumbar, Bayan Lepas, Penang:

Prices are quoted in Malaysian Ringgit and are inclusive of all items described in each voyage's description on our website. All voyages are subject to weather and sea conditions. We reserve the right to alter or curtail any voyage where safety requires it.

4. Booking and Payment

All bookings are confirmed by written agreement (email) between Deepkeel and the guest. A deposit of 50% is required to secure a booking date; the balance is due 48 hours before departure. We do not store payment card information. Payment methods are communicated at the time of booking confirmation.

5. Cancellation by Guest

Cancellations must be communicated in writing to [email protected].

6. Cancellation by Deepkeel

We may cancel or postpone a voyage due to weather conditions, vessel maintenance requirements, or circumstances beyond our control. In such cases, we will offer a full refund or, where possible, an alternative date. We are not liable for travel, accommodation, or other costs incurred by guests as a result of a cancellation we initiate.

7. Guest Responsibilities

Guests are expected to:

Deepkeel reserves the right to refuse embarkation to any guest who appears to be under the influence of alcohol or substances, or whose behaviour poses a risk to the safety of the voyage. No refund will be given in such circumstances.

8. Health and Safety

All guests participate at their own risk. While we take every reasonable precaution to ensure safety, the sea carries inherent risks. We provide life jackets, safety briefings, and compliant safety equipment, but cannot eliminate all risk. Guests with serious heart conditions, respiratory conditions, or other health concerns should seek medical advice before participating.

9. Intellectual Property

All content on this website, including text, images, and design elements, is the property of Deepkeel. You may not reproduce or use this content without our written permission. Photographs taken during voyages by guests may be shared freely for personal use. Commercial use of images taken on Deepkeel vessels requires prior written consent.

10. Disclaimer of Warranties

We provide our services with reasonable care and skill. We do not make any warranty as to specific wildlife sightings, sea or weather conditions, or outcomes of any voyage. The sea is variable by nature and we cannot control it.

11. Limitation of Liability

To the extent permitted by Malaysian law, Deepkeel's liability to any guest shall not exceed the price paid for the specific voyage in question. We are not liable for indirect or consequential losses, including lost income, missed connections, or emotional distress arising from a voyage cancellation or alteration.

12. Indemnification

By booking a voyage, you agree to indemnify and hold harmless Deepkeel and its crew from any claim arising from your failure to follow safety instructions, your misrepresentation of health information, or any other breach of these terms.

13. Governing Law and Dispute Resolution

These Terms and Conditions are governed by the laws of Malaysia. Any dispute arising from them shall first be addressed through direct communication with us. If not resolved within 30 days, disputes may be referred to the courts of Penang, Malaysia.

14. Changes to These Terms

We may update these Terms and Conditions from time to time. The version in effect at the time of your booking confirmation governs your voyage. We recommend reviewing these terms before each new booking.
